Directions for use

The holdings of the Müther Archive are available free of charge for scientific, journalistic or private studies.
Prior registration for use of the archive is absolutely necessary. For legal or conservation reasons, it is possible that holdings may be restricted or temporarily unavailable for use. Please inform yourself about accessibility before a visit. Please bring your identity card with you when you register in person.

Fees

The use of archive materials in the archive is free of charge. The making of reproductions (photocopies, photographs, scans) and their publication are subject to a fee. The costs incurred can be obtained from the archive.

Image files (JPEG or TIFF) can also be transmitted online or on data carriers.

Terms of use

I. Authorisation for use

§ 1
The right to use archive material in the Müther Archive is available to any person who can credibly demonstrate a justified interest in such use, provided that this does not conflict with protection periods or restrictions (data protection law). A legitimate interest exists if the use is requested for official, scientific, journalistic or educational purposes as well as to safeguard legitimate personal interests. Persons who wish to inspect archival records submit an application for use. In doing so, the applicant must give his or her name and address and describe the purpose and object of use as precisely as possible. The application for use is valid for the current calendar year. The participation of auxiliary staff in the use of archival material must be applied for separately.

§ 2
The user service of the Müther-Archive is provided:

1) by the presentation of archive material for inspection in the rooms of the archive. For this purpose, a user application and an order form must be filled in.

2) by providing information orally or in writing, usually limited to information on the relevant archive material and information on the type, scope, condition and usability of the archive material. There shall be no claim to information requiring an unjustifiable amount of work.

3) by submission or submission of reproductions.

The archive staff is available to advise the user. The usual method of use is personal inspection in the rooms of the archives.

II. Use

§ 3
Inspection of the ordered archive material is subject to prior registration and appointment.

§ 4
As a rule, archival material is released for use 30 years after the closure of the records. This does not apply to documents that were already intended for publication when they were created. Archival material relating to a natural person may not be released for use before 10 years have elapsed after the death of the person concerned. If the year of death cannot be determined or can only be determined with unjustifiably high effort, the term of protection ends 90 years after the birth of the person concerned.

Archival material which is subject to special secrecy regulations may only be released for use 60 years after its creation. In the case of personal archival material subject to special secrecy and protection regulations, the term of protection is 30 years after death if the year of death of the person concerned can be determined or 90 years after birth if the year of death of the person concerned cannot be determined or can only be determined with unjustifiably high effort.

§ 5
The periods of protection under § 4 also apply to use by public bodies.

§ 6
The use of personal archival documents is permitted, regardless of the protection periods, if the person concerned or, in the event of his death, his relatives have given their consent. In the latter case, consent must be obtained from the surviving spouse, after his or her death from his or her children or, if there is neither spouse nor children, from the parents of the person concerned. The declaration of consent is equally required for intended publications and other forms of public dissemination.

§ 7
For the use of personal archive material, the user undertakes to protect the personal rights and copyrights and other legitimate interests of third parties. The user is liable in case of violation of these rights and interests.

§ 8
The user undertakes to treat the archival material submitted for inspection with the utmost care and to return it in the same condition as when he received it. Painting and underlining shall be considered as damage. The user is fully liable for any damage caused by him. Any existing damage discovered by the user after the materials have been handed over must be brought to the attention of the supervisor.

§ 9
The use of archive material is to be restricted or refused if there is reason to believe that it is necessary,

    that the welfare of the Müther Archive, the University of Wismar or the Müther family suffers significant disadvantages,

    that the state of preservation of the archive material is impaired,

    that the use of the system creates an unjustifiable administrative burden.

§ 10
At the request of a user and after approval by the archive management, reproductions of archive material can be made. A form must be filled in for this purpose. There is no legal claim to the production of reproductions.

§ 11
Archive documents with blocking or protection periods are excluded from the possibility of reproduction. If there are blocking or protection periods, the documents may be inspected instead of being reproduced in urgent cases to protect personal rights and in the case of urgent scientific work on a case-by-case basis. In order to protect the archive material or to safeguard the interests of third parties worthy of protection, information can also be provided exclusively about its contents. Requests in this regard, stating the reasons for the necessity, must be addressed to the archives in writing. The application is not formally binding. The necessary permission is granted by the management of the archives. The statement of reasons in the case of a negative decision can be omitted.

§ 12
The user undertakes to provide the Müther-Archiv with a specimen copy (in printed or digital form) of publications that he has created using archive material free of charge. This also applies to exams, diploma, bachelor and master theses, dissertations and catalogues as well as audiovisual productions.

§ 13
Archival records are to be cited in publications as follows: "Müther-Archive, University of Wismar, signature ...".

III. Reproductions and fees

§ 14
The use of archival documents in the rooms of the archive is free of charge. In justified exceptional cases, reproductions of archival records may be made. Fees for reproductions are to be paid according to the scale of fees.

§ 15
The written consent of the Müther-Archiv must be obtained for the reproduction or digitalisation of documents as well as for the transfer or inspection to/for third parties. The necessary permission is granted by the archive management. The statement of reasons in the case of a negative decision can be omitted.

IV. Lending of archive material

§ 16
Archival material can be borrowed for exhibition purposes. There is no right to borrow archive material. Lending requires a written agreement (loan contract) between the Müther-Archiv and the borrower.
